COMPETITION TERMS & CONDITIONS FOR TURN UP SUMMER WITH SAMSUNG AND TELKOM

Please read these Competition terms and conditions (“Terms and Conditions) carefully. Entry in this Competition will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Competition. All participants during the term of this Competition agree to be bound by the following Terms and Conditions.

1. Competition:
1.1. The Competition will be known as the Turn Up Summer with Samsung and Telkom Competition (“Competition”).

1.2. The Organizer of the Competition is Samsung Electronics South Africa Proprietary Limited, registration number 1994/003872/07 and/or its agencies (“Organizer”).

1.3. For the Purposes of this Competition:
1.3.1. “Tier 1 Qualifying Device” means the Samsung Galaxy Z Fold8 Ultra, Z Fold8, Z Flip8, S26 Ultra, S26+, and shall exclude devices purchased from countries outside of South African borders including parallel imports.

1.3.2. “Tier 2 Qualifying Device” means the Samsung Galaxy S26, S26FE, S25FE, A57, A37, A27, A18, A08, and shall exclude devices purchased from countries outside of South African borders including parallel imports.

1.3.3. “Qualifying Device” means Tier 1 Qualifying Device and Tier 2 Qualifying Device collectively.

1.3.4 “Participating Network Operator” means any online or physical Telkom owned stores, Telkom franchise stores, and Telkom inbound and outbound call centres within the Republic of South Africa.

1.3.5 “Contract” means a fixed-term agreement between a subscriber and a Network Operator for the provision of mobile telecommunication services and/or devices, subject to monthly payments and specified terms and conditions. Also known as a post-paid operator mobile tariff plan.

1.4 Entry into this Competition is limited to the participants as defined in clause 3 below. Accordingly, any application for entry into this Competition, which is made by a third party on behalf of a participant, is strictly prohibited and will result in immediate disqualification from participation in this Competition
 

2. Competition Period:
2.1. The Competition will run from 07 October 2026 [00h00] to 15 February 2027 [23h59] (“Competition Period”).

2.2. The duration of the Competition Period may be extended or curtailed at the discretion of the Organizer. 


3. Who may enter:
3.1.1 be a citizen or legal resident of the Republic of South Africa;

3.1 In order to gain entry into the Competition, the participant must, at the date of the commencement of the Competition Period:

3.1.2 be residing in the Republic of South Africa;

3.1.3 be at least eighteen (18) years old;

3.1.4 be in possession of - 3.1.4.1 a valid South African identity document or applicable residency permit;

3.1.4.2 valid proof of Contract upgrade, or new Contract with verifiable details of the Qualifying Device such as where and when the Qualifying Device was purchased or upgraded, and a valid IMEI number, and in other cases, the name of the purchaser.

3.2 Misrepresentation of participants or in store sales representatives will result in the disqualification from the Competition and possible legal action.

3.3 Participation in this Competition excludes the Organizer, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with the Competition and their spouses, life partners, parents, children, siblings, business partners or associates.

 

4. How to enter the Competition:

4.1 In order to gain entry into the Competition, the participant must – :

4.1.1 be a participant as set out in clause 3 above;

4.1.3 have signed up for a new Contract or upgraded their existing Contract from a Participating Network Operator and successfully redeemed the promotional offer in accordance with the Turn Up Summer with Samsung and Telkom promotion (“Promotion”) terms and conditions during the Competition Period for either -

4.1.3.1 a Tier 1 Qualifying Device for entry into Phase 1 of the Competition, or;

4.1.3.2 a Tier 2 Qualifying Device for entry into Phase 2 of the Competition.

4.1.4 All participants not selected as winners in Phase 1 or Phase 2 will automatically be included in Phase 3 of the Competition.

4.2 Only participants who have validly completed all of the requirements of the Promotion will be automatically entered into the applicable phase(s) of the Competition.

4.3 Notwithstanding a participant’s successful redemption of the promotional offer, if it is subsequently discovered that the participant failed to comply with any of the terms and conditions of the Promotion, such participant shall be automatically disqualified from the Competition. 

4.4 Participants must be and remain in possession of a valid proof of Contract upgrade, or new Contract for the Qualifying Device. Such proof must contain verifiable details, including (but not limited to) the IMEI number of the Qualifying Device.

4.5 Participants must have downloaded the Samsung Members Application from the Samsung Galaxy Store or Google Play Store on the Qualifying Device and be a registered subscriber of the Samsung Members Application managed by the Organizer. Participants are required to remain registered members of the Samsung Members Application for the duration of the Competition Period and at the Draw Date in order to retain their eligibility.

4.6 Entry to this Competition does not make any participant a winner.

4.7 The Organizer accepts no responsibility for entries lost, misdirected, illegible, late, mutilated or altered. Entries that do not comply with these Terms and Conditions will be disqualified, subject to clause 4.7 below.

4.8 Errors and omission may be accepted at the Organizer's discretion. Failure by the Organizer to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.9 It is the participant’s responsibility to ensure that all information provided to the Organizer during the Promotion and the Competition is accurate, complete, and up to date. Participants must maintain the accuracy of such information throughout the Competition Period. Any inaccurate, incomplete, or outdated information may result in disqualification from the Competition, irrespective of whether the promotional offer was successfully redeemed.

 

5. Can I qualify more than once for the Competition:
5.1. The Competition is limited to 1 (one) entry per participant for each successful redemption of the offer in the Promotion subject to clause 5.2.

5.2. All participants who are not declared the winner in Phase 1 or Phase 2 of the Competition will automatically be entered into Phase 3 of the Competition.

5.3. Should there be any dispute in this regard, the Organizer shall be sole adjudicator of the dispute and the Organizer’s decision shall be final.
 

6. Prize:
6.1. The Competition will afford participants who have successfully entered, in accordance with these Terms and Conditions, an opportunity to be included in at least one of three lucky draws to stand a chance of winning one (1) of 5 (five) prizes as detailed below (“Prize”):

6.1.1 Phase 1: Stand a chance to win either the first prize of R150 000.00 (one hundred and fifty thousand Rand) in cash; or to win the second prize of a Samsung 100” Neo QLED Vision AI Smart TV with model code QA100QN80FU valued at R100 000.00 (one hundred thousand Rand).

6.1.2 Phase 2: Stand a chance to win either the first prize of R100 000.00 (one hundred thousand Rand) in cash or the second prize of a Samsung 100” Neo QLED Vision AI Smart TV with model code QA100QN80FU valued at R100 000.00 (one hundred thousand Rand).

6.1.3 Phase 3: Stand a chance to win R 50 000.00 (fifty thousand Rand) in cash. 

6.2 Terms applicable to the cash Prize:

6.2.1 All cash Prizes will be paid to the winning participant(s) via EFT (electronic funds transfer) into a valid South African bank account held in the name of the winner. No EFT’s will be made to any third-party accounts.

6.2.2 Once a participant is selected as a winner of a cash Prize, they will be contacted by the Organizer as provided for in Clause 7. The winner will then have 5 (five) calendar days, from the date of contact, to share proof of their bank account details such as an official bank confirmation letter. Any documentation submitted must confirm the winner's bank account details to the Organizer's satisfaction.

6.2.3 If the selected winner fails to provide satisfactory proof of their bank account details within the 5 (five) day period, the Prize shall be forfeited and another winner will be drawn by the Organizer.

6.2.4 All banking fees, transaction costs, and bank administration charges associated with receiving or processing the cash Prize will be borne solely by the winner and are for their own account.

6.3 Terms applicable to the Samsung 100” Neo QLED Vision AI Smart TV with model code QA100QN80FU:

6.3.1 Once a participant is selected as a winner of a Samsung 100” Neo QLED Vision AI Smart TV Prize, they will be contacted by the Organizer as provided for in Clause 7. The winner will then have 5 (five) calendar days from the date of contact to provide the Organiser with a copy of their valid TV license issued by the SABC, which TV license must be registered in the name of the winning participant.

6.3.2 If the selected winner fails to provide a valid TV license registered in their own name within the 5 (five) day period, the Prize shall be forfeited and another winner will be drawn by the Organizer.

6.3.3 All costs, fees, levies, or expenses associated with obtaining, renewing, or maintaining the TV license shall be borne solely by the winner and are for their own account.

6.4 The Organizer reserves the right to change the Prize should they deem necessary, to a prize of similar economic value.

6.5 The Prize is not transferable and no substitution, cash redemption or assignment of the Prize is permitted.

6.6 The Prize may differ in colour and specifications from the Prize shown on marketing material.

6.7 Any and all tax implications and liabilities as a result of winning the Prize will be solely borne by the winner.

7 Draw:
7.1 The lucky draws to determine the 5 (five) winners will be held by the Organizer on 17 February 2027 (“Draw Date”) as follows:
7.1.1 Draw 1 will determine the 2 (two) winners of Phase 1;

7.1.2 Draw 2 will determine the 2 (two) winners of Phase 2; and

7.1.3 Draw 3 will determine the winner of Phase 3.

7.2 If for any unforeseen reason the draw(s) cannot take place, then the Organizer will endeavour to conduct the draw(s) within a reasonable period thereafter and shall provide details of the new draw date(s) on its website.

7.3 The draws will be supervised by an independent auditor, registered accountant, attorney or advocate.

7.4 A participant selected as a winner who does not comply with the provisions of these Terms and Conditions will forfeit the Prize.

7.5 Once a participant is selected as a winner, they will be contacted by the Organizer via the contact details provided during the Promotion to request a copy of their identification document or any other documentation, which the Organizer may require, in order to verify their identity and confirm that they have complied with the provisions of these Terms and Conditions.

7.6 The Organizer shall in its sole discretion determine the time period for a Prize to be claimed or for delivery to be accepted.

7.7 In the event that a winner is unreachable within a period of 7 business days from the applicable draw date, ineligible or fails to claim or accept the Prize, the Prize shall be forfeited and another winner will be drawn by the Organizer.

7.8 The draw results to determine the winners are final and no correspondence will be entered into.

 

8 Limitation of Liability:

8.1 To the extent permitted by Consumer Protection Act and any other applicable law: 8.1.1 the participant and winners hereby indemnify the Organizer against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Competition;

8.2 the Organizer excludes all warranties (express or implied), representations and liabilities regarding this Competition other than for death or personal injury caused by its negligence and/or fraud.

 

9 General:
9.1 The Organizer reserves the right, at any time, to verify the validity of entries and participants (including but not limited to a participant’s identity, age and place of residence) and to disqualify any participants who submit an entry that is not in accordance with these terms and conditions or who tampers with the entry process.

9.2 In accordance with the confidentiality policies and practices of the Organizer, none of the entry details of any participant in this Competition will be disclosed or used by the Organizer for any purposes other than for entry into the Competition and in accordance with clause 9.3 and clause 9.4.

9.3 Participants acknowledge and accept that the Organizer may utilise a third party to contact the participant, in the event that the participant is a winner and to arrange delivery of the Prize. In order to affect the contacting and delivery process, the Organizer’s shall provide the participant’s information to such third party and by entering the Competition, each participant consents to this information being provided to the authorized third party.

9.4 The Organizer will not use details of participants for Samsung related communication should the participants opt-out to receive further communication from the Organizer.

9.5 Information regarding the Competition that is published on authorized advertising material will also form part of the Terms and Conditions of the Competition. In the event of any conflict between such advertising material and these Terms and Conditions, these Terms and Conditions shall prevail.

9.6 The Organizer may require the winner to be identified, photographed, filmed and the aforegoing to be published in any media and the winner's name and image may be published. Winners may however at any time decline the use of their name, likeness or image by the Organizer.

9.7 The Organizer may in its sole discretion amend these Terms and Conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised Terms and Conditions on www.samsung.com/za/offers. The onus rests on the participant to constantly check the Organizer’s website for updates to the Terms and Conditions.

9.8 If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organizer, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organizer reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any participant or to modify, suspend, terminate or cancel the Competition as appropriate, subject to the approval of relevant regulatory authorities (if required).

9.9 Save as permitted by law, the Organizer reserves the right to cancel, suspend or terminate this Competition, without notice at any time, and such cancellation, suspension or termination shall be deemed to have taken effect from the date of publication on www.samsung.com/za/offers.

9.10 No liability shall lie against the Organizer in favor of any participant, any winner and/or third party arising from such cancellation, suspension or termination. Accordingly, the participant waives their right which they may have against the Organizer and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organizer.

9.11 Any dispute or claim arising out of or in connection with the Competition shall be governed by and construed in accordance with the laws of South Africa.

9.12 The Organizer reserves the right to withhold the Prize until it is entirely satisfied that the claimant of the Prize is the bona fide winner, and reserves the right to call for such proof as it may deem necessary.

9.13 The Organizer accepts no liability or responsibility, whether occasioned by any circumstance not foreseeable and not within its reasonable control for late or delayed delivery of the Prize owing to, but not limited to, stock unavailability, strike, lock out, destruction of Prize on route to winner/s by any means, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earthquake or other acts of God.

9.14 If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable it will be: 

9.14.1 read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;

9.14.2 severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

 

10 Consumer Protection Act:

To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.
